TikTok Contest Rules

Article 1: Organiser and Contest Definition

JOSKIN PIRARD HOLDING, whose registered office is located at rue de Wergifosse 39, 4630 Soumagne, Belgium, and whose ECB number is 0453.428.775, is setting up a contest on the Internet on the occasion of Easter. It is entirely free and takes place on the company's entire website: https://www.joskin.com/, from Wednesday 5 April 2023 at 10:00 am to Thursday 13 April 2023 at 4:00 pm. Platforms such as Facebook, Instagram, Tik Tok and Mailjet will be used to redirect users to this contest. The JOSKIN PIRARD HOLDING company is designated below as: the “Organiser”. Any person wishing to take part in the contest is referred to below as "the Participant" or "the Participants". The Participants meeting the conditions set out in Article 4 and complying with all of these rules are referred to below as "the Winners".


Article 2: Eligibility

The participation in this contest is open to all natural persons who are at least 18 years old, with the exception of the employees and workers of the JOSKIN Group or any other person connected with the organisation. If it appears that a minor has taken part in the Contest despite being ineligible to do so and has won a prize, the prize may not be awarded. With the prior agreement of the Organiser, this prize will be given to the Winner’s parents or one of his/her legal guardians. In the latter case, the receipt of the prize will only be valid in the event of confirmation of the minor's participation in the contest and acceptance of these rules, to which the parents or legal guardians will adhere in their own name rather than on behalf of the minor. If the parents or legal guardians refuse, the prize will be awarded to another Participant. The participation in this contest implies the acceptance of these rules and the completion of the online validation form.


Article 3: Contest Duration

The Contest will start on Friday 13 May 2022 at 12:00 AM (UTC+2) and will end up on Friday 20 May 2022 at 12:00 AM (UTC+2). The participations before or after this period will not be valid. The Winners will be notified by reply to their TikTok comment (see Contest terms and conditions) within one month of the contest closing date. They will then be asked to contact the TikTok @joskin.official account as soon as possible to arrange how they will receive their prize.


Article 4: Contest Terms and Conditions

In order for the Participant's participation to be validated by the Organiser, the Participant must read and accept the contest conditions and the data protection regulations. Participation in this contest implies the acceptance of the contest terms and conditions. The Participant must be able to provide, at any time, a proof of his/her identity and age so that the Organiser may be able to check any abuse. The aim of the contest is for the Participant to subscribe to the official JOSKIN TikTok account (@joskin.official), like the contest video, and comment it by tagging a friend. The Participant also has the possibility to double his/her chances by following the link in the biography of the TikTok account (@joskin.official) leading to page: https://www.joskin.com/en/tiktok. The Participant will then be able to fill in the pop-up he/she gets on the screen with his/her TikTok user name. He/She can then validate his/her action once he/she has accepted the general conditions. There will be 50 Winners for this Contest. One of the 50 prizes defined in Article 6 will be awarded to each Winner. • If there are 50 or fewer Participants listed as potential Winners after the contest has ended, these 50 (or fewer) Participants are designated as the Contest Winners. • If there are more than 50 Participants listed as potential Winners after the contest has ended, the Winners will be decided by random draw. The 50 Participants drawn at random are then designated as Winners of the Contest. Only the Participants who meet the above conditions will be eligible for a prize.


Article 5: Organiser’s Liability

Any participation that is incomplete, incorrect or contains errors will be rejected, without the Organiser being held liable. Any false statement by a Participant will result in his/her exclusion from the Contest without the Organiser being held liable. The Organiser reserves the right not to accept, or even to exclude from the Contest, any Participant who does not comply with one of these Contest terms and conditions. The Organiser reserves the right to terminate a Participant's participation if it does not go according to plan, for example: bug, virus, unauthorised intervention, fraud, infringement, action by a company, technical problem or any other cause beyond the Organiser's control that would be contrary to the administration and security of the Organiser. The Organiser shall not be liable in the event of force majeure causing it to cancel, shorten, postpone or modify the Contest. The Organiser shall not be liable in the event that the TikTok application, the TikTok account (@joskin.official), the contest video or the website https://www.joskin.com/ are temporarily unavailable during the contest. The Organiser shall not be liable for the consequences of a change of postal address and/or TikTok account (user name) of the Participant. The Organiser can on no account be liable for errors in the encoding of Participants' data (incorrect or unknown TikTok usernames). The Organiser, its staff or third parties called on by the Organiser in the context of the Contest cannot be held liable for any direct or indirect damage related to the participation in the Contest and affecting persons, Participants or their hardware and software or the Winners, in particular during the participation in the Contest or during the awarding of prizes. This exemption from liability also applies to technical problems and/or errors in the hardware and software used, which make the participation in the Contest temporarily impossible or very difficult, or even interrupt it. The Organiser cannot therefore be held liable for any risks related to the use of the Internet or e-mail that would prevent the Contest from running smoothly. More specifically, the Organiser cannot be held liable for any damage to the Participants' electronic equipment during the participation in this Contest. The Organiser cannot be held liable for delays or errors in the delivery of prizes. In the event of permanent damage on the supplier side, e.g. in the event of bankruptcy, the Organiser cannot be obliged to take over the delivery itself or to compensate the Winner(s). Since the communication channel is exclusively electronic, it is up to the Participants to regularly consult their TikTok account and the comments of the contest video, as well as to take the necessary steps to recontact the TikTok JOSKIN account (@joskin.official) in the event of winning. The Organiser cannot be held liable if, after sending the reply to the TikTok comment, this message cannot reach its destination for a reason beyond the Organiser's control.


Article 6: Prizes

50 unique prizes are offered by the Organiser. They are therefore a gift. No cash or cheques may be offered in exchange for the prizes. The Organiser reserves the right to change the gift without notice. If this were the case, the value of the prize would be equivalent to the replaced product. After the end of the Contest, a ranking as detailed in Article 4 of these rules will be made. Only one prize will be awarded to any one individual. The prizes are: 50 x 1 prize including a random cap from the models "green cap", "yellow cap", "est. 1968 cap" and "camouflage cap". These are unique prizes. So there will be 50 winners, each of whom will win a cap (random model). The Winners will be notified with a reply to their TikTok comment within one month of the contest closing date and will then be asked to contact the TikTok @joskin.official account as soon as possible. They can either come and collect their prize at the JOSKIN Shop (Rue de Wergifosse, 39 - 4630 Soumagne - Belgium), or it will be sent to them at the postal address they will have communicated beforehand. If the information provided by one of the Participants is incomplete and/or does not allow him/her to be informed of his/her win, he/she will lose the status of Winner and will not be able to make any claim. The Organiser cannot be held liable for any technical malfunctions in connection with this electronic prize notification. In addition, each Winner allows the Organiser to communicate his/her first name, city and country on its communication networks.


Article 7: Legal Jurisdiction

These contest rules are governed by Belgian law. In the event of persistent disagreement regarding the application and/or interpretation of these rules, and in the absence of an amicable agreement, any dispute will be submitted to the jurisprudence of the district of Liege (Belgium).


Article 8: Validity

If any of the conditions of these rules are deemed to be invalid, this shall not affect the other provisions of these rules, which shall remain in force. A clause which may be invalid by virtue of its wording shall, as far as possible, be interpreted as closely as possible to the original intention of the parties so that it can be replaced by a valid clause which comes as close as possible to the result originally intended by the parties through the invalid clause.


Article 9: Acceptance of these Rules

The participation in the contest implies the unconditional acceptance of these rules (no dispute in this respect will be taken into consideration) and of any decision taken by the Organiser.


Article 10: Complaint

Any complaint regarding this Contest must be communicated to the Organiser by registered letter with acknowledgment of receipt, within ten days of the occurrence of the event that gave rise to the complaint. On expiry of this period, the complaint will automatically be considered as null and void and, moreover, as time-barred.
